DraftKings legal states July 2025
Where is DraftKings legal?
DraftKings Sportsbook is live and legal in the following US states as of May 2025:
Arizona, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Virginia, Washington D.C., West Virginia, Wyoming.
These states all permit DraftKings to provide a legal online sportsbook; these state governments have regularised betting platforms that are completely safe for users to check out if they are so inclined.
Players should always check their local rules and state laws, as it’s possible some states could apply conditions or limitations on the bets that can be placed online.
Where is DraftKings DFS legal?
DraftKings Daily Fantasy Sports (DFS) is available to play in 44 US states.
DFS contests are legal in almost every state because they are considered a game of skill rather than a form of traditional gambling.
As of May 2025, the only states where DraftKings DFS isn’t permitted are Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.
That means players in states like Texas, California, and Florida, all states that have yet to make sports betting legal, can legally enter DFS contests on DraftKings.
DFS is a great entry point for users seeking to compete for prizes without betting real money on a sportsbook.
Where is DraftKings Casino legal?
DraftKings Casino is only available in states where online casino gaming is fully regulated.
As of May 2025, the DraftKings Casino legal states are as follows:
Connecticut, Michigan, New Jersey, Pennsylvania, and West Virginia.
Customers in these states will be able to access DraftKings Casino via the same app or website as Sportsbook and DFS.
DraftKings Casino offers real-money slots, table games, and live dealer alternatives.
To play in all five states, you need to be at least 21 years old and be physically located in the state.
DraftKings Casino is unavailable in any state without legal and regulated online casino gaming.
Where can you bet in person with DraftKings?

Legal timeline
Possible future legal DraftKings states
Based on current legislation and market trends, several US states are likely candidates for DraftKings' expansion in the near future.
In our view, Missouri, Minnesota, and Hawaii are the top states to watch, as all three have active or advancing sports betting bills and strong legislative interest.
Missouri has already passed a bill in the House, and if Senate negotiations move forward, a launch could come as early as late 2025.
Minnesota is further along than in previous years, with bipartisan backing and tribal cooperation gaining traction.
Hawaii remains a long shot, but recent proposals show a shift in momentum.
We’re closely monitoring these and other emerging markets.
As more states finalize frameworks for regulation, DraftKings is well-positioned to enter quickly due to existing infrastructure and partnerships.
